Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Evolution Football Intelligence platform operated by Evolution Ltd. (“Evolution”, “we”, “us”). By registering a squad or using the platform you agree to these Terms in full.

1. The Service

Evolution Football Intelligence is a subscription-based platform that provides cognitive assessment, player development planning, session logging, and coaching analytics tools for football academies and clubs. Access is granted on a per-squad, per-season basis following payment and account activation.

2. Subscriptions & Pricing

• Subscriptions are annual and priced per registered player per season (12 months from activation date).
• Squad Plan (up to 15 players): USD $220 per player per season.
• Extended Squad (16+ players): USD $250 per player per season.
• Prices are quoted in US dollars and are exclusive of any applicable local taxes.
• Squad size may be increased mid-season at a pro-rated additional cost. Contact intelligence@evolutionbda.com to arrange.

3. Payment

Payment is processed securely via Authorize.net. By submitting your registration you authorise Evolution to charge the stated amount to the card provided. Card details are tokenised by Authorize.net and are never stored by Evolution. A confirmation email is sent upon successful payment.

For static-site registrations, Evolution’s billing team processes the payment intent within 24 hours of receipt and activates your account by email.

4. Free Trials & Promotional Codes

• Free trial periods (where offered) grant full platform access for the trial duration. At the end of the trial the full subscription fee is charged automatically unless cancelled beforehand.
• To cancel before a trial ends, email intelligence@evolutionbda.com with your club name at least 48 hours before the trial end date.
• Promotional codes are single-use, non-transferable, and subject to the conditions stated at the time of issue. Evolution reserves the right to withdraw promotional codes at any time.

5. Cancellation & Refunds

• Subscriptions may be cancelled at any time by emailing intelligence@evolutionbda.com. Cancellation takes effect at the end of the current subscription period.
• Refunds are issued at Evolution’s discretion. Where a technical fault prevents access to the platform for more than 5 consecutive business days, a pro-rated refund will be offered for the affected period.
• No refunds are issued for partial seasons where the platform was accessible and functioning.

6. Acceptable Use

You agree to use the platform solely for lawful purposes related to football coaching, player development, and club administration. You must not:

• Share access credentials with individuals outside your registered club.
• Attempt to reverse-engineer, scrape, or extract the platform’s data or algorithms.
• Enter false, misleading, or fraudulent information about players or transactions.
• Use the platform in any way that violates applicable law, including data protection legislation.

7. Data & Privacy

Your use of the platform is also governed by our Privacy Policy, which forms part of these Terms. All player data entered on the platform is stored locally in your browser and remains under your control. Evolution does not access or process player assessment data on its servers.

8. Intellectual Property

All platform content, design, algorithms, and methodology are the intellectual property of Evolution Ltd. and are protected by copyright and other applicable laws. Your subscription grants you a non-exclusive, non-transferable licence to use the platform during the subscription period.

9. Limitation of Liability

To the maximum extent permitted by law, Evolution’s total liability to you for any claim arising under or in connection with these Terms shall not exceed the amount paid by you in the 12 months preceding the claim. Evolution is not liable for indirect, consequential, or incidental losses.

10. Changes to the Service

Evolution reserves the right to modify or discontinue features of the platform at any time. Material changes that affect the core service will be communicated to registered clubs by email with at least 30 days’ notice. Continued use of the platform after notice constitutes acceptance.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of Bermuda. Any dispute arising shall first be referred to mediation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Bermuda.
